3. Legal Uses of Our Service

Our service may be legally used for:

• Downloading your own original content
• Content with Creative Commons licenses that permit downloading

4. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been infringed through our service, you may submit a DMCA takedown notice to our designated Copyright Agent.

4.1 Required Elements

Your DMCA notice must include ALL of the following information:

   • Mailing address

Upon receiving a valid DMCA takedown notice, we will:

1. Review the notice for completeness and validity within 24-48 hours
2. Remove or disable access to the allegedly infringing material if the claim is valid
3. Notify the user who posted the material (if applicable)
4. Document the takedown in our records
5. Take appropriate action against repeat infringers

6. Counter-Notification Procedure

If you believe that material you posted was removed by mistake or misidentification, you may file a counter-notification.

6.1 Required Elements for Counter-Notification

Your counter-notification must include:

1. Your full name, address, phone number, and email
2. Identification of the material that was removed and its location before removal
3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
4. Your consent to jurisdiction of Federal District Court in your district (or where we are located if you're outside the U.S.)
5. Your consent to accept service of process from the person who filed the original DMCA notice
6. Your physical or electronic signature

6.2 Counter-Notification Process

After receiving a valid counter-notification:

1. We will forward the counter-notification to the original complainant
2. We will inform them that we may restore the material in 10-14 business days
3. If the original complainant does not file a court action, we may restore the material

7. Repeat Infringer Policy

Youtuvert has a policy of terminating access for users who are repeat copyright infringers. We track:

• IP addresses associated with repeat infringement
• Patterns of infringing behavior
• Multiple valid DMCA complaints

Users identified as repeat infringers may be permanently blocked from accessing our service.

8. Limitations of Our Service

Please note that Youtuvert:

• Does NOT host any copyrighted content on our servers
• Does NOT upload content to YouTube or other platforms
• Provides a tool that accesses publicly available content
• Cannot control what users choose to download
• Deletes temporary files within 24 hours automatically

9. Good Faith Requirement

Both copyright holders and users must act in good faith:

• Copyright Holders: Only file DMCA notices for content you actually own or represent
• Users: Only download content you have legal rights to access
• Both: Provide truthful and accurate information in all communications

10. Misuse of DMCA Process

The DMCA includes penalties for misrepresentation. Anyone who knowingly misrepresents that:

• Material is infringing, or
• Material was removed or disabled by mistake

...may be liable for damages, including costs and attorney fees incurred by the alleged infringer, the copyright owner, or the service provider.
